Terms & Conditions

This website, mobile application ecosystem, and accompanying cloud infrastructure are owned and operated by Waqt-Pe (a platform managed by Sura Construction Services and integrated into the Sq-Feet Software suite; henceforth collectively referred to as ‘Waqt-Pe’, ‘the Company’, ‘We’, ‘Us’, or ‘Our’).

 

By initializing, downloading, or interfacing with the Waqt-Pe mobile applications, web-based admin dashboards, or the official waqtpe.co.in domain (collectively termed the “Service”), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service (“Agreement”).

If you are entering into this Agreement on behalf of a construction company, contracting firm, or other legal entity, you represent and warrant that you possess full corporate authority to bind that entity. In such cases, “You”, “User”, “Customer”, or “Subscriber” shall refer directly to that collective enterprise.

 

Core Operational Definitions

  • The User App: The personal self-service application deployed on individual mobile devices for engineers, project managers, and supervisors to track localized GPS/geofenced attendance.

  • The Kiosk App: The central mass-tracking terminal app mounted on a shared mobile device or tablet at site entry gates, substituting for traditional biometric hardware via rapid facial recognition check-ins managed by a designated supervisor.

 

Section 1: Subscription, Billing, and Financial Transactions

 

1.1 Free Trial Deployments

We may make specific configurations of the Waqt-Pe platform available to you on a temporary trial basis free of charge. Any data, custom labor rosters, or site grid configurations inputted during an unactivated free trial will be permanently purged three (3) weeks after the trial’s expiration date, unless a valid commercial subscription under the Sq-Feet Software ecosystem is executed. During trial phases, the Service is provided strictly on an "as-is" basis without operational warranties.

 

1.2 Billing, Pricing, and Invoicing

  • Advance Payment: The Service is billed in advance on a recurring monthly or annual cycle and is entirely non-refundable. No proportional refunds or system credits will be issued for partial utilization, site downscaling, or mid-cycle account terminations.

  • Sovereign Currency & Taxes: All basic financial transactions are denominated and processed in Indian Rupee (INR). Advertised corporate fees are exclusive of statutory taxes, levies, or Goods and Services Tax (GST) imposed by Indian fiscal authorities, which will be appended to your statement.

  • Invoiced Corporate Accounts: If the Company has approved an independent invoicing schedule with you, you agree to clear all undisputed invoices within 30 days of issuance. Overdue commercial balances will incur interest at a rate of 1% monthly (or the maximum limit allowed by law). We reserve the absolute right to suspend terminal sync pipelines and database visibility if an account falls into arrears.

 

Section 2: Account Cancellation and Data Management

 

2.1 Customer-Initiated Cancellation

Subscribers may request termination of their active time-tracking instance at any step by submitting an official directive to support@waqtpe.co.in. To prevent automated contract renewal actions, cancellation requests must be settled prior to the upcoming billing roll date.

 

2.2 Immediate Access Cutoff

Upon structural account cancellation, access to the central dashboard and field terminal sync capabilities will turn off. If a user authenticates back into a deactivated workspace portal, the platform will prompt the user that further access triggers subscription renewal.

 

2.3 Post-Termination Data Purge

In compliance with data hygiene practices and local privacy frameworks, the platform triggers a hard automated deletion script thirty (30) days following a subscription's formal termination. This process permanently scrubs all customer worker rosters, operational logs, and biometric face profiles from active disks.

Section 3: Shared Responsibilities and System Boundaries

 

3.1 Our Service Commitments

We will utilize commercially reasonable benchmarks to maintain database availability 24 hours a day, 7 days a week. We are not responsible for site connectivity shortfalls or sync lags resulting from factors outside our immediate control, including local telecom disruptions, construction zone power blackouts, extreme weather events, or cloud hosting provider outages.

3.2 Workforce Data Guardrails (DPDPA 2023 Alignment)

The Customer acts as the primary manager of all data and is responsible for establishing a legal basis under the Digital Personal Data Protection Act (DPDPA), 2023 for all worker registries, contractor details, and biometric facial data uploaded to the platform.

Waqt-Pe handles this metadata strictly as a Data Processor. We enforce systematic, administrative, and physical boundaries on AWS and Google Cloud data centers inside India to keep your site infrastructure secure.

 

3.3 User-Generated Workspace Content

Our platform enables site supervisors to upload data, images, shift updates, and structural logs ("Content"). We claim no ownership over this data, but you grant us a clean, non-exclusive, royalty-free license to host, parse, and transmit this content to ensure successful real-time rendering on your company dashboards.

 

3.4 Password Safeguards and On-Site Security

You are solely responsible for protecting your administrative credentials and supervisor pins. Waqt-Pe cannot evaluate individual device integrity across your team's field devices and disclaims liability for data missteps stemming from shared passwords or compromised on-site tablets.

Section 4: Marketing Promotional License

Unless expressly restricted by an active enterprise non-disclosure agreement, you agree that Waqt-Pe and its partner network at Sq-Feet Software may list your company or trade name within our client directories, B2B marketing slides, and digital portfolios to highlight your use of our automated field-tracking ecosystem.

 

Section 5: Legal Limits, Liability, and Jurisdiction

 

5.1 LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Waqt-Pe, Sura Construction Services, or its software partners be held liable for any special, incidental, indirect, punitive, or consequential damages whatsoever—including losses from site delays, miscalculated labor overtimes, profit reductions, or data corruption—arising out of or connected to the use or underperformance of the platform.

Where specific statutory frameworks prevent this boundary, our aggregate liability for any operational grievance shall never exceed the total subscription fees paid by you to us during the twelve (12) months immediately leading up to the incident.

 

5.2 Disclaimer of Warranties

The Service is provided to construction teams on an "as-is" and "as-available" baseline. We issue no warranties regarding consistent network connection strength across remote construction grids, or that facial recognition calculations will seamlessly handle all outdoor dust or lighting environments without minor on-site adjustments.

 

5.3 Governing Law and Dispute Forum

This Agreement, its structural covenants, and any operational disputes arising from your use of the platform shall be governed by and interpreted under the Laws of India. All legal proceedings or arbitration actions linked to this framework shall be subject to the exclusive jurisdiction of the competent courts in Vadodara, Gujarat.

 

5.4 Evolution of Terms and Service Adjustments

We reserve the right to modify, adjust, or replace sections of these Terms of Service at any time to reflect changing compliance rules or software updates across our ecosystem. Continued use of the mobile terminals or central dashboard following the publication of revised terms constitutes an acceptance of those updates.
